3 Fred BacKhaus, 2 South Street, Guthrie, Oklahaus, was a member of the Jury
in the trial of WY. E. Hale and John Ramsay, charged with the murder of Henry Roan, a
_| meatricted Osage Indian, which resulted in @ mistrial after several hours of delibera-
;4 tign. Mr. Backhaus stated to this Agent that after receiving instructions from the
Court and retiring to the Jury room they soon took a ballot, the results being seven
-4 fer conviction and five for acquittal. Fhe case was given them August 20th, 1926, at
T$0;10 A.M., and they continued to ballot Friday afternoon emi the forenoon of Saturday
din tht position. When Juror Mills became slightly ill, br. Hayes, Foreman, told him
(Backhaus] and Dwinnell, who was strong for conviction, that he was going to vote for
{ sequittal for once and see what effect it would heave; that on the next ballot there = |
Z.were geven for acquittal and five for conviction, that only lasting for one ballot.
