The objectives of the conspiracy are alleged to have been accamplistied vy means of an understanding, among the defendants, effectuated by refusals to supply off-list dealers, coercion of distributors to adhere to resale prices and to refuse to sell to nonconforming dealers, and the advertising boycott. The over-all purpose of these activities is stated to be stabili- zation of retail prices. | Assistant Attorney General Stanley N. Barnes, head of the Antitrust Division, said: “This case, which slleges exclusion of certain retail dealers from the rifle scopes business, presents issues involving both vertical price fixing imposed by the scope menufacturere end boycotts by the manufacturers and pub- lishers against advertising of dealers who charge less than the manufacturers’ list prices. Criminal action is insti- tuted, in this instance, in line with the announced policy of the Department of Justice to seek indictments against violators wherever per se violations of the antitrust laws are considered to exist."
