It is noted that at the time of LEWIN's
indictment, the Government entered a motion for a
restraining order and establishment of a performance
bond concerning LEWIN. In this motion, the Government
pursuant to Title 18, United Statés Code (USC),
Section 1963, moved that an order be entered in joining
and restraining LEWIN, his officers, agent, servants,
employees, attorneys, and other persons during the
pendency of this proceeding and until further order
of the court from the following:
1. Selling, transferring, leasing, pledging,
encumbering or otherwise disposing of any rights,
titles, or interest in or to any goods, titles,
chattels, fixtures, whether real or personal,
owned, Operated, held or used by the defendant in
connection with the retail and wholesale
sales and manufacturing of jewelry by Universal
Gem and Jewelry Company, Incorporated. The fore-
gOint property or interest therein shall include
but not be limited to jewelry, gems, precious
metals, coins, presses, molds, smelting equipment,
safes, display cases, furniture, contracts, accounts
receivable, shares of stocks or other evidence of
ownership or interest in such property or any
entity having rights, title or interests in such
property.
It was further moved that the court
appoint a duly qualified appraiser and authorize
and direct said appraiser to appraise and take
inventory and accounting of all the values or
all of the above-described property or interest
therein, and to make a due return thereof to this
court, for the purpose of establishing the amount
of satisfactory bond to secure performance of the
terms and conditions of the aforesaid restraining
order and that thereupon the court set the amount
of such at twice the value of the property so
appraised, and require and direct the defendant
forthwith to deposit such bond, with acceptable
surety, with the clerk of the court.
