= ~ CG 87-40596 By communication dated August 2, 1974, the Dallas Office of the FBI was advised that investigation at Chicago, Illinois, had failed V4 to develop any information which would indicate 17) Pe involved in the instant investigations. By communication dated gugust 28, 1974, the Dallas Office was advised that according to United States Department of Justice Attorney GREGORY WARD that on or about September 3, 1974, there will be a status report rendered in United States District Court (USDC) concerning the setting of a trial date in the instant matter. 4t that time, Departmental Attorney WARD advised the Government anticipates dismissing the RICO charges against LEWIN, inasmuch as the Government cannot establish a pattern with regards to LEWIN's receiving stolen property, namely jewelry, involved in the two Dallas burglaries. LIC , On August 28, 1974, GH Revenue Officer, Department of Treasury, Internal Revenue Service (IRS), 3720 North Kedzie Avenue, Chicago, Illinois, made available a notice of levy concerning ADOLPH LEWIN and/or JOYCE LEWIN, 2501 Pebbleford Lane, Glenview, Illinois. This notice of levy stated that there is now due Over and unpaid to the United States of America from the taxpayer the amount of $156,445.65. p70 At that time, Revenue Officer QD served the Department of Justice with a notice of seizure regarding the jewelry obtained by the FBI from LEWIN on April 14, 1974, which jewelry has not as yet been identified as being stolen property. Revenue Officer — aha at that time, made SA custodian of this jewelry until such time as it was or was not identified as stolen property. On September 5, 1974, in United States District Court.(USDC), Northern District of Illinois (NDI), the Government withdrew the RICO counts contained in the indictment of LEWIN's. At that time, the USDC set the date of September 16, 1974, for the date to set a trial date in connection with this matter.
