In choosing whether to use the search warrant process or
alternative less intrusive means, such as subpoenas or summonses, to
obtain documents, Agents should consider:
(1) Whether use of the alternative means will give
advance notice of the government's interest, with the resulting
likelihood of destruction, alteration, or concealment of the documents
sought;
(2) Whether the government has an immediate need to
obtain the documentary materials.

Violation of the guidelines requires appropriate
disciplinary action by the Agency in which the violator is employed.
Exclusion of evidence as a remedy for failure to comply with the
guidelines is expressly prohibited.
