On December 30, 1933, et Sharnee, Oklahoma, Filbur ‘Underhill,
for thom a Federel warrant of arrest was issued under the indictment
returned st Kansas City, Missouri, September 1, 1933, charging him with
Conspiracy to Deliver a Federal Prisoner, wes located in a house at 606
Vest Derey Street. The Specisl Agent in Cherge of the Oklahoma City
Office, upon receiving this informetion, organized a posse end proceeded
to Shawnee, Oklahoma, He wes accompanied by Special Agents Frenk Smith,
K. 3. Deaderick, G. H. Frenklin, J. M. Edgar, T. M. Birch and Paul Hansen;
Deput; Sheriffs). I. Fads, John Adems, George Kerr end George Catron; and
Oklehone City Police Detectives Lieutenant C. 0. Hurt, Charles Ryan and
B. A. Bryce. Upon arriving in Shernee, Oklehoma, the night Chief of Police,
Frenk Bryant, was contected but appurently exhibited reluctance to reid
the house in which Underhill hed been located for the reason thet he had
lerrned thet it had been rented to one Hatley ane a well known insurance

Acting pursuent to instructions of the Special Agent in Charge
of the Oklahoma City Office of this Division, the raid wes mede upon the |
_hous¢e Epon arriving at the rear. ofthe house,. Underhill was plainly

Licutenent Hurt “approached the window; and shouted, "Kilbur, throy up
your hendas: inis is the lew." Underhill hesitated for a nonent and —
then suddenly whirled to pick up his gun, at which time Hurt fired directly
st him with a tear gas gun end the Special Agent in Charge of the Oklahoma
City Office also fired point-blank et Underhill with a Thompson machine-gun,
Underhill failing to the floor. Hurt and the Agent in Charge after firing
into the house, backed aray from the window in order to be out of sirht.
At about this time, gun flashes came through the side window of the house,
and officers in the reer opened fire directly into the house end the squad
of officers stetioned in front of the house thereupon opened fire into the
house from thet direction. After the firing cessed it ras discovered
thet Underhill had escaped from the house and hed taken refuge in a4 second-
hand furniture store owned by R.E. Ovens, 509 East Mein Street, Shawnee,
wherehe ves taken into custody and because of the serious wounds was
‘ {mmediately removed to the Shawnee Municipal Hospital. On Jenuary 6, 1934,
a he wes removed from the Hospitel to the Stete Penitentiery, et McAlester,
_ Oklehoze, where he died on thet dete from wounds received while resisting
( errest.
