With reference to Division letter dated January 20, 1934, .
relative to payment of hospital bills and incidental expenses in con-
nection with the Wilbur ¢. Underhill case, please be advised that J
have, in accordance with the Division's instructions, taken this up
with the United States Marshal at Oklahoma City. We discussed the
matter at length and although he appeared very willing to help insofar
es he could, did not know of any way in which the proper voucher could
_- be prepared which would pass the Comptroller for the reason that no. -
Federal warrent for Underhill was ever placed in the hands of the.
Marahel in this district. It will be recalied that the indictment ©
pending acainst Underhill was at Kansas City, Missouri and, aithough |
e certified copy of said indictment was sent to the United States.
Attorney at Oklahoma City some days after Underhill had bean captured,
no fugitive complatnt was ever filed in view of the fact thet it waa
expected that he would die mamentarily. Therefore,/there was no
Borel process outstending for Underhill, Eva MacNichols or Ralph.

° I thought that { nasmuch as Underhill was an escaped conviet
from the State Penitentiary of Oklahoma, that it might be possible to
induce that institution to pey Underhill's bills and took it up with
the Warden, who referred me to the State Board of Affairs. ,
On Januery 31, 1934 I hed a conference with sneteate Board
_of Affaire, of which Mr. W. C. Hughes ia Gnairman, in company with —
Stanley Rogers, Sheriff of Cklehoma County, and explained the situation
to them with respect to Underhillta part of the expenses, outilning to,
