they were willing that we snoould move him if we desired. They os fe
stated confidentially, however, that if it weren't Underhill,
they vould not permit his being x moved as the move Brobably would -*

Colvin at this time stated the doctors felt that
Underhill might not last through the night. He further stated
that it would be impossible to move Underhill that day because
it had not been decided where they would move him; that the
Warden of the State Penitentiary at McAlester, Oklahoma
previously advised him he was ready to take him off of his |
hands as he is wanted at McAlester to serve a life sentence.
It appears that the Attorney General for the State of Kansas
had called at Shamee on the afternoon of the lst, thinking
that he would have Underhill imnediately removed to Lansing,
Kansas where he is also wanted to serve a life sentence.
The Attorney General was advised that it would be necessary to
contact Special Agent in Charge Colvin and had apparently
passed Colvin enroute to Shawnee.
To-day at noon I understand thet Special Agent in Charge.
Colvin callec you, at which time he was instructed to make
imaediate arrangements to have Underhill removed and he should
advice tue Rensus aad Oklahoma authorities that they must settle
between themselves as to which State is to have hin,
Shortly after your conversation, I called Colvin on.
the telephone. He stated he had talked to the Attorney General
of Kansas, who was satisfied to permit the Warden of the _
McAlester Penitentiary to take Underwood. Further, that he communicated
with the Warden, who was on his way to Shawnee and expected to
arrive al 3:00 o'clock. The Warden is taking an ambulance in re
order to remove Uncerhill. Colvin told him that you had instructed
‘him to escort Underhill with the proper guard to the penitentiary .
and he had prepared to do that.
I instructed Colvin to advise the Director promptly ty so
telephone when all arrangements had been made and the actual
time of leaving Shawnee; elso to again notify the Director of
the time of arrival when Underhill was safely in the penitentiery.
I inquired of Colvin as to the correctness of & rumor | nek
