With reference to the charge of poor management by
the grouping of lew enforcement officers about the prisoner, it ©
should be stated that Frank Nash, the prisoner, was accompenied on
the train by experienced Agents of the Division and by Chief of
Police Otto Reed, of McAlester, Oklahoma, and that they were met at
the station by other experienced Agents of this Division and special
officers from the so-called. "hot squad" of the Kansas City Police
Department, who had full opportunity to offer any suggestions
j relative to the manner of accompanying Nash acrose the station
‘¢ plaza and relative to the parking of the car, which, incidentelly,
ir. Reppert mentioned. The officers accompanied the prisoner in
fan-shaped formation across the station plaza, apparently believing
that formation to.be the best means of defense. Mr. Reppert apparently
overlooks the fact that his criticism is directed to the deceased
officers, as well as to the few remaining elive, and among those
deceased officers were two members of the Kansas City Police Department.
With reference to the charge thet the KecElroy case could
heve been investigated without the sid of Federal Agents, it can only
be stated that City Manager icElroy not only wrote to the Division,
expressing his gratitude and thanks for the assistance rendered to the
Kansas City police in connection with this case, but he called personally
upon the Attorney General, Mr. Keenan and the Director to express hia
thanks. The facts of this case are well known. Special Agents of the
Division at Kansas City, of course, did obtain information which led
to the immediate cepture of the kidnapers. They were cooperating with
the police officers. In fact, an officer of the Kansas City police
was along with Agent Vetterli when he discovered the telegram which
led to the location of the kidnapers. Mr. Reppert, himself, was in
constant contact with Agent in Charge Vetterli throughout this investi-
gation and apparently there was nothing to mer the cooperation between
the city police and the Agents of the Division at that time. The
inform.tion gathered by the Agents was furnished to the State
Prosecutor. Mr, Keenan, Special Assistant to the Attormmey Generel,
attended this triel, . and assisted the Prosecutor, and Agents of this
Division likewise assisted in the prosecution.
With reference to the fourth charge, this charge is
unsupported by any facts thet are known to the Division. If Chief
Higgins has solved the case, it would be interesting to know the
identity of the persons responsible for the shooting, according to
his solution, and whether or not they ere in custody, and if in
custody whether the fects have been furnished to the District Attorney.
