MEMORANDUM FOR ACTING SPECIAL ACINT IN CHARGE D. 0. SMITH
On the evening of November 1, 1933, the writer was in apart-
ment 207, Sherone Apartmants, in company with other Agents, having under
j ‘surveillance the apartment in which it was believed Verne Miller was stay-
° ing. ,
Agent was in the kitchen et approximately 8:50, keeping
the Miller apartment under surveillence through the service door when |
he was advised that a telephone call hed been overheard in which instruc-
tions had been issued to bring Mrs. Moore's roadster to the hotel. Agent
Notesteen then relieved the writer in the kitchen. It was believed by
everyone present that possibly it was Miller's intention to emerge from
his apertment and drive eway in the roadster. Special Agent Guinane
instructed the writer to proceed to the Sheridan Road entrance of the
hotel and cover that entrance. Agent made an effort to leave the apart-
Ment. However, Agents Nadala and Keating and the police officers who
were stationed at the door of the apartment suggested that he not leave
at that time, inasmuch as Bobby Moore was then leaving the apartment.
For about five minutes after that time it was felt thet Agent should not
leave the apartment to proceed @ownstairs, inasmach as it was thought
that Miller would emerge at any moment. However, it was finally decided
that the writer should proceed downstairs.
Agent left the apartment, proceeded to the elevator and
took the same to the first floor and then proceeded out of the Sheridan
Roed entrance of the hotel, turning right on Sheridan Road to Galt Avenue.
It was Arvent's understanding that Agents Lockerman and Rice were in Galt
Avenue covering the areaway in back of the Sherone Apartments, into which
the fire escape descended. Agent crossed Galt Avenue and proceeded down |
the North side of the Avenue, looking for Agents Lockerman and Rice.
Immediately after Agent turned into Galt Avenue he ob-
served the Auburn convertible coupe of Bobby Moore perked in the street
in front of the Galt entrance to the Sherone Apartments and observed that
there was someone in the car sounding the horn. Almost immediately a man |
wes seen emerge from behind two of the parked cars and get into the auto- |
mobile. At the same time Agent observed Sergeant Freemuth, Agent Nichols
and Sergeant Kempster coming out of the Galt Avenue entrance of the hotel.
Agent Nichols ran along the sidewalk to a position about opposite to the
