Reference is meade to your telegram dated the third in-
stent end to telephonic conversation had with iir. Hughes of the pivision

were in the vicinity of the Sherone apartments on the night of the

Special Agents A. E. Lockerman, J. L. Madale, J. T. Hartin and J. J.
Keating,
Reference is made to paragraph two, page four, of the
stetement subuitted by Agent Medala, wherein he refers to a conversa-
tion had with the writer on the morning of November 1, 1923, indicating
his suzgestion to erash Apartment 211 was disregarded. I bes to state
that this suggestion was not disregarded, however, the writer and Arent
ve Ce Ryan had spent the :ajority of the night in the elley south of
the Sherone apartments and it was observed thet verious people, sone
masked, and others celebrating nalloween, were passing through the alley
and on all sides of the Sherone Apertnents, for which reason it was
ceened dangerous to rush the apartment at night, in view of the fact
thet innocent people may heve been killed. the writer suggested to
Accent Guinene that the epartment mt be crashed until a better arranrce-
ment could be made for covering the exits to the alley and the roof and
amore suitable station obtained for the agents and officers, in the dey-
tine oreferably, if MILIGR should escape thragh a window or down a
