He sev Nichols rumning on the sidewelk to & position opposite the froat of the Bobby lioore car, point his pistol et the occuyents and yell to thei to halt; thet Bobby jioore imnedietely scresmed and the cer sterted; tact he, zgent Sith, heard severei shcts evidently fired by iiiller and &lso cbserved that Nichols fired several shots at the cer. He also observed Sergeant Treenuth fire several shots vith his pistol end Sergeant Xempster endeavored to imiediately open fire vith his machine gun, which wes deleyed erocrently due to peoole being on both sides of the street and, further, because of 2 man alighting from a car perked directly in the line of fire. Tae set-up et the tine thet Vere Liiller energed from apert— acnt 2ll tes as follows: Agent iiotesteen anc irs. Rogers were in the kitchenette. «agents Mecala, Nichols end hezting anc. Sergeents Freenuth,. Curtin end Kempster vere at the door of roon 207. agent Guinene stated he had just left the group of zgents «t the door to proceed into the kitchenette at the tine the identificetion wes mede., Apparently the only outside guards were éigents Lockermen éna Fice, who were in é cer perked on the opposite sice of the street con Gait Avenue enc the Lgents with police officers in en cdjoining a pcurtz.ent watching the fire escape. There wes no one on Sheridan Roed excepting thet jgent WW. 4. Suith had been sent by égent Guincne to the Sheridan foad entrance imnediately pricr to the tine thet iiiller stepped out of cpartment 211. The cer of agents Leckerman and Rice was perked in = cirection just opposite to thet in which Bobb; Hoore's car was headed. Right here I think it should be observed that ordinary precsution should heve prompted the parking of & car by the Agents or police officers scuevhere in the vicinity feced in the direction thich 4 cer would normally teke in driving up to the entrance on Galt Avenue. I believe this is one of the very bad errors which occurred as then the cér drove off with :tiller there wes no one to follor him and, as it tured out, the car wes only able to drive taree blocks then Miller had to cbandon it end if he had been followed he coulé hive been taken at the tine cf cbenconing the car.
