It wa later learned by this agent through conversation with all
of the agents involved that Sergeant Fremuth obstructed the staira and ans
epperentiy in not too much of a hurry to get dow; that shen he arrived in
the lobby, Agent Nichols and State Policeman Buck Kempster ren past Frewath
into the lobby, and observing a man in a brow esuit end hat at the desk,
placed guns against himjand Nichols, immediately upon sensing that this man
was not MILLER, ran out into the street and ws followed shortly by Sergeent
Kempster. At the time Nichole reached the street, he turned around end sav
Sergeant Premuth standing at the door apparently inactive for the instant. -
Agent Nichols, on seeing the Auburn automobile beginning to pull away from .
the curb, rao up to this car and shouted, "Stick ‘an up*. He was answered
by two shote from MILLER in the car. The oar was being driven by BOBBY
MOORE. As the oar pulled away from the curb, Nichols shot twice at MILLER
end turned around to see where the machine gun was. At thie time, Kempster
came out of the door with the machine gun and ren out into the street behind
the Auburn automobile; and because of the fact that the neighborhood was
crowed with pedestrians and people were running across the narrow street
(Galt Street), Kempster wis unable to open up with the machine gun until
MILLER was approzimtely one block awy.
Agent we still in the apartment at thia time, having just arisen
from bed at the time Special Agent Guinan edvised him of the telephone
conversation indicating that MILLER was about to leave the apartment, and ~
had taken up hie post in the kitchen immediately upon being notified of this
information,

VIVIAN MATTHEWS was brought into apertment 207 and wma under guard
by Agent Yan Wiggoner. .
MS. JOHN MADALA began woeping and was almost at the point of
hysterics during the shooting as was also VIVIAN MATIBENS, both of whom were
in the apartment immadiately after agents and police officers at the door
had left, ;
Agent W. A. Snith (according to hia statement to we}, who had
previously left the apartment to assemble the gun squads, me at the tine
of the shooting approximately three-fourths block awey on Sheridan Road.
