WEMORANDOM.
Mr. Conroy telephoned this morning to state that all arrange~
ments have been made to take the witnesses in the Kansas City massacre case
to the Leavenvorth Penitentiery about one o'clock today, tut the Deputy
Varden at the penitentiary edvised thet Mr. Sanford Bates has issued orders
that GeorgeXelly should be heldincommunicado at all times and will have
to have instructions from Mr. Bates before he will allow the witnesses to
see Kelly. I stated I would esk li, Bates immediately te telegrerhically
tesue orders that the Terden allow the witnesses to see Kelly, Bailey and
Betes.

Mr. Bennetts of the Bureau of Prisons was con‘acted, and he |
stated he sould telephonicelly or telegraphically issue orders to the Warden
to accede to requests of Mr. Conroy to see these prisoners, end allow Mr.
Conroy to be accompanied by such persons es he desires.
