Mr. Nathan advised that as he entered the jail today Bates was te- -
fing brought downstairs, at the request of the Marshal, to have a private con-
ference with Katherine Kelly; that it seems that Katherine Kelly said to United
States Attomey Hyde that if she could talk to Bates she would get out of Bates
where his share of the money is and tell Hyde; that he, Mr. Nathan, immédiately
told Hyde he was opposed to this procedure but of course could issue no in-
structions; that it was decided he could call Hyde and tell him how he felt
about the matter; that he did this, and Hyde decided to hold up this action
until an opportunity presented itself when they could all discuss the matter.”
Mr. Nathan stated that the attorneys were in again today to see the
prisoners, and he told the Marshal he thought the Attorneys should only see
the prisoners once a day between certain hours, and that each time they should ©
have specific permission from Byde. Mr. Nathen stated the Marshal is new at
this job, only having been there a month or 80. ot

Frank Nash recapture. Mr. Vetterli steted he advised the Police offictale ” ote,
he would need some assistance as they were bringing in a Federal prisoner; -...-=
thet they advised they would provide some men from the cruisers; that he ad- os
vised the prisoner was Frank Nash, a dangerous gangster, and they stated —
they would give him men from the "hot shot car" in this event. Mr. Vetterli’
stated that the guards (Agents and police) accompanying Frank Nash spread over
an area of about 15 or 20 feet. Mr. Vetterli stated it has developed that ~~ .
