On March 6, 1951, the trial of this case on the
auperseding i indio otment of January 31, 1951, commenced before
UJ. &. District Judge Irving Ry Kaufman in the Southern Distrtes
of New York. <At the outset of the case United States Attorney
Irving He Saypol rnoved to sever Anatoli 4. Yakoulev fron the
trial, which motton was granted. fhe selectton of a jury of
twelve with two alternates wae completed on March 7, 19514
Counsel for the defendants made motions to dianise the tnrdiotment
on various grounda which were dented by the Courte Mr. Saypol
then aade a motion to sever David Greenglasa from the indictuent
because Greenclass had already p Dleaded quilty. This motion was
granted by the Court,
Mr. Saypol opened the Government's case and addressed
the jury. He tnforned the fury that tt was thetr duty to
protect the rights of each tndtutdual and of oll people by
proceeding diltgently against those who operated agatnat the
Government. He potnted out that the Grand Jury had charged the
_ foretgn power, and that thts charge was one of unusual atgnificances
- He defined "consptracy™ and stated it required proof of only one
overt act of any one of the consptrators. He atated that the
evidence in this case would cone from sone wttnesaesa who
partiotpated with the defendants and from sone whe were pteked
