Regional Director's Report on Objections are to be found in the form
files of the National Lebor Relations Board in Washington, and gemine
signed copies of both of these documents may be found in the formal files '
in the Chicago Regional Office of the Board. in addition, the informal
files in the Chicago effice should contain . the detailed mterial obtained
by Bertha and Bajork in their investigation, together with any affidavits,
memoranda, exhibits, etce, secured by thea. J think that Kane, who at that
time was attorney for the Progressive Miners of America, was of some sub~-
stantial value to Bertha in bis investigation of these objections as @
source of information in conneetion with some of the issues raised.

Carl Elshoff, omer of Mine B, or any other cfficials of the United Mins
Workers that may be of assistance in this case?

application cards or membership cards which would purport to prove that the
United Mine Workers of America bad a majority of the miners signed up in
Mine B prior to that Union's signing a contract with Mr. Elshoff on August
18, 19377 ,

When I first came to the Chicago office in September 1937 I did make a
portion of the commerce investigation for the Board in the oase then pending.
At the time I did thie I went through the entire file and discussed the
ease with Bajork. My best recollection is that at that time I did see
either some authorisation cards or a petition, I believe the latter, but
J am uncertain as to whether this petition was one designating membership
in the United Mine Workers oe whether it was one for the Progressive Mine
Workers. I do not at the moment recall anything specific as to the date
ef the petition. I suggest that Mr. Bajork or Mr. Bertha would be in a
wach better position to supply definite information on this point than I an.

"4. I do not think of anything exept the mention I have already made of
Kane, the attorney for the Progressives, as having been of some assistance
to the Board in its investigation. Je may also be somewhat pertinent that
John Fancher, et that time vice president of the Progressives, and the san
who represented them directly in the Board's cases, waa one of the 20 some
wen sentenced in the Springfield cases proseouted by the Departaent of Justice
againatthe Progressive Miners at about the same time as the oase (03S) related
to herein. In fact it is ay recollection that some of the other Progressives
at Mine B were also involved in this same matter end were either actually in
jail or oat on bond at the time of the December election held ty the Board.
