Jn 1930 ELSHOFF assisted Panther Creek in the purchass of

‘1938. Pantber Creek finally agreed to accept « clain of Mine B -
which was never realised, es paramt of pert the azoumt do :
Mine B and also to allow ELSHOFF §1650,00 for his share of tue Eapire
transaction, Mr. SIMPSON advised that it appeared to hin that a
loss was sustained of the total of the two amwts, namely #620266, , |
although he could net locate the entry charging the asomt of $4642
from the suspense accomt to a loss sccomt, wr, ROBERT C, SCLOMN
- QDVISED THAT ALTHOUGH TEE ELSHOFF business was bandied by bis bro
¥. SOLOMM, now decessad, he was onder the that the
reason ELSHOFF quit buying coal from Panther Creek was because Panther
Creek did not want his business after he failed to pay his acoomt .
currently, It is noted, however, that ELSHOFF had entered into m
agreement with Peabody in denuary 31938, which from the facts
to have been prior to any of bis difficulties with Panther Creek,
Mr, SIMPSOS, after consulting daily sanifests of seles advised
that KLSSOFF was allowed a 25 cent per ton diacowt on car-load coal,
Be further advised that out of this 25 cents ELSHOYF bad to pay the
gales tax on coal not sold for re-sale, If the sales tax were at tas
yate of 6 sents per ton, the net discomt to ELSHOFF would beve been -
about 19 centa per ton, Considering that this conl wes selling at abomt
$2.00 per ton at this time the percentage of discomt would be approxi~
mately 94%, as compared to SF at Peabody, 3% is pointed aut that these
computations are made without benefit of reviewing Mine B or Peabody
books, ;
