A search of the records of HLRE reflected an additional informal
file under case file No. XIII-C-1665, entitied “Oarl BH. Bishoff and Progressive
Mine Workers of Americe, District No. 1". Mr. BOTT adviaed tht q charge was
filed in this case on September 23, 1941 by WILLIAM KECK, President of Die-
trict 1, PMN, alleging violation of Section 8, subsections {1) ani (5); that
preliminary inquiries were made by the Field Examiner of NLRB, and thet the
Case wis withdrawn on December 22, 1941. |
In accordance arrangements made through the Bureau and the De-~
partment, Bpecial Agent reviewed the above file on September 15,
1943. All pertinent information wes photostated. FPhotostatic copies were

By Letter of September 22, 1941, WILLIAM KECK, President of District
No. 1, PMA, transmitted a charge egainst CARL BH. ELSHOFF, alleging he engaged
in unfair labor practices in that on or about September 15, 1941, he refused
to bargein collectively with the authorizad representatives of PMA previously |
chosen by the majority of the production and maintenance employees at Mine “A"
to represent them for the purpose of collective bargaining.

dated October ¢, 1941, it appears that RAY RDMUNDSOW discussed on October 4,
instant matter. EDMUNDSON stated to AAGNER that ELSHOFF head purchased Mine “A”;
that the mine had not been operated sinoe Maroh 31, 1941 when the contraet be-
tween the mine and former company had expired; that it was customary not to
operate the mine during the sumer ponths; thet when it wes announsed in the
newspapers that ELSHOFF had purchased Mine "4" representatives of the Locel
union Piet had ¢ome to EDMUNDSON and stated that they wanted to join UMW, "D-
MUNDSON told tham to hold a meeting of the whole looal and to take the neo-
eseary action to dissolve the local, and then they could join the UMW; thet
