MEMORARDUM FOR THE DIRECTOR
B 0 ON
Re: ne "Bp" o- Jlleged Violation
Your memorandum of Septeaber 15, 1945, transmits tro
copies of photostats, consisting of eight pages each, repre-
senting the pertinent information conteined in the 15th
Regional National Labor Relations Board file No. XITI-C-1665,
at Chisago, Illinois.
It is requested that Mar Wagner be re-interviewed
end asked to confirm the facts ob are set forth in his
severe) memoranda to the Boerd eovering his negotiations
with subjects Elshoff and Eammdson. Special reference
should be made to Wagner's statenent in his memorandum of
November 1941, that "When Elshoff first purchased the
assets of tat, be hoped to mine the sean of coal in
Mine 's' from Mine 'B'*, and the statement in the came
mmorendum at page 2 that "Elshoff stated that he did not
delieve he was obligated under any circumstances to hire
any of the former employees of Mine ‘at since he had not
taken over a corporation tut had merely purohased some of
the assets of that corporation.” Also of significance is
the statement made by Wagoer in his memorandum of Ootober
4, 1941, that "“EKdmundson stated that these employees
undoubtedly were afreid that Blshoff would mine this
newly soquired property through Mine ‘B'", and that “To
avoid this they came to him and signed applications for
meabership in the U.M.W.4." It fis apparent that Edmundson’,
contentions in this regard were hypooritical in view ef his
inowledge that he and Lewis were advancing $60,000 to enable
Elehoff to purchase the mine. It is hoped that Mr. Wagner's WV
recollestion of exact conversations oan be refreshed by bis
reading of his mesoranda. : to
CL Respectfully,
