CLARK advised that in general FaLCETTI could justify the employ-
ment of every man, CLAW further atated, however, that in some cases he

In connection with the charge alleging violation of what hr. CLARE
believed to Section § (5) of the Netional Laber Relations Act which has to
do with refusal to bargain in good faith, Mr. CLaRE etated that JOBUpKaNz,
attorney for the Progreseive Mine Workers, contended that ELSHOFF had de-
leyed the proceedings by feilure to attend meetings that had been arrenoged,
and in every other possible way. CLARK had no specific information to .
offer in regard to thie contention. Ee did atate thet he had talked to
ELSECEY in regerd to his negotiations with the PW and had been advised by
ELSECFF thet he was having great difficulty in negotiating a contract vith
the k..° inasmuch as the local union at Mine "B" refused to give him the
wame terms thet were effective in the mines of nearby cometitors.
CLaRK stated that ELSEOFF showed him vhotoatatic coniers of the
books of competing PMY mines, indicating that maintenance men were veld
only when the mine worked, ELSHOFF stated that he wea attempting to secure
terms that were as favorable to him but wes unable to eecure them with the
PiW, iLSECSIF alao indicated that he knew that the UMW adhered etrictly to
the terms of their agreements, whereas thie wes not true of the PM", who
made side agreements with various mine owners. oth ELSHOFF and FaLC=ivri
exoreesed at verioues times to CLARE their dislike for the PMY, giving as
their reasons loose orgrnization and the tendency the union had to indulge
in side agreements with operetors.
CLARK gteted in regerd to the contempt charges. that the National
Labor Reletions Board wes reoueeted to file by PN’, that they involved the
refusal of iine "B" to rehire four PY werkers who had been sentenced to
Leavenworth on Federal charges arising during the eerly part of the iine "B*
controverey when a great desl of violence wes indulged in, These men had
been paroled end were attemoting to secure employment at Kine "B", CLARE
