It is noted in ELSHOFr's letters tnst he continually refers to. "we". It is
difficult to ascertain whether by this expression ELSHOFF wes refering only
to himself in a collective senge or whether it also included other individuals.
These letters are set forth as follows:

"Dear Mr. Elshoff:
"Thié is to confirm our discussion this morning, wherein it was in-
dicated ths nther Creek Mines, Inc, is willing to lease to you all of its
corel mining broperties, with the option to purchase or to renew, all on the
following basis.
“Term of Lease: 10 years.
"Rent: Koyalty bosis of 10 cents per ton on production; minimum
royelty of $90,000 per year.
"Taxes, Insurance end Repairs:
To be paid and carried by Lessee.
"Additional Conl Rights: Lessor to purchase and provide 211 ad+
ditional coel rights which Lessee may require for the con
tinued operation and development of the mining properties;
or, on failure so to do, Lessee to have privilege of ace
quiring, at Lessee's expense, such additional coal rights
with a credit of five cents per‘ston on coal produced there-
from,
"Persone] Property: Lessor will sell to Lessee, at invoice price
