For the information of the washington Field Office, Mr. 0. S. S:ITH
was Ficld Examiner out of the 43th Region, Chicago Office, National Labor
kelations Board. Mr. LEO'ARD JURK, Regional Director, during part
‘of the Mine "B" controversy, on interview has advised that SIZTH was the

opirion as to whether or not the dismissal of or the refusal to dismiss
the twelve miners expelled from the Progressive Mine WorRers of america
on May 11, 1937 was an unfair labor practice. He should also be questioned
as to whether or not RiY <DMINDSON, wiLlToR J. JaiGS or any other official
of the Unitcd lfine workers of america ever showed to him a petition or a
group of application cards or membership cards which would purport to
prove that the United Ifine workers of america had a majority of the
miners Sioned ip in iline 3" prior to that union's Signing a contract
with ELSHOFF on .ugust 18, 1937, or after that and prior to the National
Labor Relations Board election on December 15, 1937. any inform tion
indicating that ELSHOFF and ELUNDSON were verking together in connection
with this matter or any occasion when S.ITH may have been contacted by
both individuals would be important to this case. Mr, SLMITH should be
questioned conecuermiig the@@fatioial Labor Relatio:s Board election of
December 15, 1937 after which the United Mine *sorkers claimed fraud in
eonnection with the election. He should also be questioned as to whether
or not any inVystigation ims made by the National Labor Relations Board
on the allegation of fraud in the clection and what, if any, was the
conclusion of the investigation.
For the further information of the Washington Ficld Division, it is
known Mr. DUKFMN represented the Nataon2l Labor Relations Board in a
stipulation and agrcemert between Hine "3" Coal Company, Progressive.
