Reference is made to the report of Special icon
dated May 18, 1943, at Les Angeles, in the above entitled matter,
which set out a lead to present the facts in this case to the United
States Attorney at Los Angeles with a view toward obtaining subject's
. internment as a dangerous alien enemy. The above report, as well es
a prior investigation, also suggests the possibility that the subject
may have left himself open to prosecution by failing to register as
an alien enemy.
—_ Information set out in the several reports in this case has
been for the most part restricted to that which might be presented to
an alien enemy hearing board without danger of disclosing that an ine
vestigation is being conducted by this office into the subject's posa-
ible Comintern connections, his connections with the Free Germany Move—
went, and his connections with known Commnists in this area. tom
tion regarding the latter is reported in the case entitled "0 '
was, SECURITY MATTER - R", since subject's activities interlock
those of the persons under investigation in that case.
The information presently available against the subject in in-
7 stant matter, although undoubtedly indicative of revolutionary tenden-
bok ies, is about the same as that developed in the case entitled, "BERTOLD
5: HT, was, ALIEN ENENY CONTROL - G",. BRECHT and the subject have been
Liaborators for years. A short time ago, with the Bureau's approval,
the BRECHT case was presented to the United States Attorney in Ios Ange~
les, who referred it to the Department for an epinion, The Department, at
_ that time, declined authorization of a Presidential warrant for BRECHT's
arrest as a dangerous alien enemy, and there therefore appears to be no
reason for referring a similar set of facts pertaining to EISLER to the
United States Attorney at this tine,
