Miller Re: Marvin Schachter In regard to answering the letter, pursuant to the Director’s inquiry, Los Angeles was requested to submit a teletype with details of he SLA shooting on May 17, 1974, in a Los Angeles residence. The #.0s Angeles teletype is attached for information. The important points are that a bullhorn was used prior to any other action being taken to warn those within the residence to surrender, and FBI Agents and police officers were fired upon by automatic and semi-automatic gunfire, and only return fire was directed at the residence. Aside from the Los Angeles teletype and references in previous teletype communications, there has been no formal investigation of the conduct of law enforcement officers and no report or analysis such as that described in the ACLU letter. Based on the information submitted by Los Angeles and all other information available to date, there appears to be no allegation of misconduct or use of excessive force. Therefore, it is my. opinion that there is no need for additional formal inquiry or the preparation of a formal report concerning this matter. Attached is a proposed letter that previously was prepared by the Correspondence and Tours Section of the External Affairs Division, but which I have modified to avoid making statements that might be used adversely to our position if the ACLU finds a plaintiff and decides to file a civil suit concerning this event. RECOMMENDATION: _ That the attached proposed letter be approved and sent to Mr. Marvin Schachter. ,
