On May 17, 1974, Mr. ‘Women's -Shoes,» The Emporium, 835 Market Street, San Fran- cisco, California, identified dark blue shoe box with the following identifying numbers and words; "3007 312 PATRIOT 8B NAVY BLUE" and bearing price tag with markings "The Emporium, 424 454A, $14,99" as being shoes sold in the Women's Shoe Department, First Floor, The Emporium, address above. These shoes are purchased from U.S. Shoe Corporation, Front Row Division, 1658 Herald Avenue, Cincinnati, Ohio. ‘This particular shoe has navy blue leather uppers with laces . and composition rubber soles and heels and is described as ‘an "Oxford tie." The inner sole of the heel contains the following "FRONT ROW, Made in Brazil, 3007 312". On the price tag the number 424 denotes the department, Women’s Shoes, the number 45 tne class or style as casual, and the A the “season", a term used to desienate length of time in stock. He further stated after checking records that this particular shoe carried the "A" designa- tion from early Fall 1973 to February, 1974, at which time it was changed to"B" although "A" tags already on the boxes - would not be replaced. His conclusion is there is no way to tell when the shoes in a box with "A" designation were sold in the absence of a sales record.
