Miller RE: ELECTRONIC SURVEILLANCE FOR INTELLIGENCE PURPOSES ON THE SYMBIONESE LIBERATION ARMY (SUA) IN THE PATRICIA HEARST CASE I feel that the SLA Hearst kidnaping case is the best case we have had since the Keith decision to employ this tactic, It appears that little initiative will be taken by the DJ to formulate legislation providing for such a mechanism, without the impetus of a celebrated case. I feel that by following the strategy described above, absent judicial action, we can impress Congress with the need for legislation providing procedures for domestic intelligence electronic surveiliance, and indicate to DJ, in its own words, "that the effect of the Keith decision is to deprive the Department of valuable intelligence information,” and that its present position (not to seek enabling legislation) should be re-evaluated.
