him during the time he was vacuuming his car, as he had
to remove his personal belongings from the trunk and had
to place them on the ground near the car and would have

Upon leaving the car wash facility, BENENSON.
-@rove south through the lot to Bancroft Street, then west
on Bancroft to Shattuck Avenue and north on Shattuck Avenue
“to Cedar Street. He turned left (west) on Cedar Street
and then made a right turn into the parking lot of Consumer's
Co~Operative Store. He parked his car in the middle lane of
three parking lanes, about midway down the aisle on the right
(east) side. Still dressed in his sweat shirt, sweat pants,
sneakers and Army~type jacket, he entered the store through
the door on the right hand (north) side of the store as one
faces the store. He estimated that he arrived at the store
at approximately 7:55 p.m. on the evening in question, and
spent 25 to 40 minutes inside shopping for groceries. He
spent approximately $11 for the groceries which he bought,
and the groceries were placed into double strengh super-
market-type bags. among the groceries he purchased were a
large jar of cranberry juice, a large can of V-& juice, a
half gallon of milk, yogurt, one pint of half and half, one
| dozen eggs, possibly several cans of tuna fish, and possibly
! ' some raisin cookies or fig newtons. “He exited the store at
approximately 8:30 p.m.-, to the best of his recollection,
through the same door which he had entered. He placed the
‘two grocery bags, one of which was considerably heavier
than the other, on the rear seat of his car.
Upon exiting the parking lot through the western.
exit, he turned north on Henry Street and then west on Vine
Street. He could not recall the exact route which he took
home, but stated that he either proceeded west on Vine Street
to his residence, or turned north on Grove Street, then west
on Rose Street and then north on Josephine to his residence
.at 1304 Josephine Street. He parked against traffic on the
‘west side of Josephine Street approximately -ten feet from
the walkway to his residence and just in front of another
car which was parked in front of the sidewalk to his residence.
