On October 2 | 22. captain Moody visited me for yet another time. This time he 3 | stated that i would be transferred to Calitornia Mens Colony, . " 4 East Facility "if I would co-operate". He stated that he 5 |- was keeping his promise" and expected that "J would keep mine”. a i stated that I had mace no promise but did indeed desire to 7 be removed from the adjustment center. on all of the occasions ‘ 8 that Captain Moody saw me ‘he tried to get me to state that I . 9 would testify for the prosecution against the defendants Jackson, 210 Drumgo and Clutchette. . 11 In September 1970 I wrote to State Senator Mervyn Dymally 12 asking him to help me get out of maximum security. Shortly — 25 afterwards I was visited by Frank Powell, minority consultant 14 1 to Director of Corrections R.K. Procunier.. Mr. Powell stated 15 | chat he had come because of Senator Dymally' s inguiry to Mr. - 26 Procunier. Mr. Powell told me that in his opinion I was eitner 17 involved in the January 16 incident. invelving the death of Officer 18 | wills or I knew who was. He made it clear that I would not be 19 released from maximum security unless I agreed to implicate the 20 | defendants Jackson, Drumgo and Clutchette._ Mr. Powell came 21 on or about September 14, 1970. On or about September 26, 22 Captain Moody came again and said that Mr. Powell had told him 25 I wished to see Captain Moody again. This was not true. I had 24 . F . said nothing of the sort to Mr. Powell. Captain Moody took me & into the telephone room and talked to me for two hours. I am in 26 fear that I will never get out of maximum security. I am in 27 28 29 fear that if I state that I am in fear of my life the officials will use that as an excuse to keep ny locked up. I fear not from inmates but from the authorities. I have described Mr. Powell's 0) . 32 visit in a letter to Senator Dymally.
