We hold that one-third of the awa. should be paid by the federal defendants and two-thirds should be paid by the state defendants. The remaining portion of that paragraph is deleted. Further ordere that the state appellees' petition for rehearing and suggestion fo: rehearing en banc concerning attorney fees is DENIED. Also ordere: that the federal appellees' petition for rehearing and suggestion rehearing en bane is DENIED. Further ordered that the motion file by the U.S. to intervene is DENIED. Judge Pell concurring. _ Filed an opinion from Supreme Court dated 6/4/80 DENIED cert on ne trial, GRANTED cert on atty. fees and REVERSED Rereyved letter from Supreme Court DENYING petition for rehearing. (z Ss Entered order that the portion of our judgment awarding attorneys' fees to plaintiff, and our further order entered 12/12/79, are VACATED, without prejudic to allowance to plaintiffs of attorneys' fees on this appeal in the event they ultimately prevail, leaving our opinion and judgment in full effect in all othe: respects and IT IS FURTHER ordered that our mandate issue forthwith.
