Memorandum to The Director Re: ISERIA EAMPTON, et al. CITY OF CHICAGO, ¢tc al. according to Judg# Swygert, a joint tortfeasor is synononous with a co-conspirator. Again, another dangsrous precedent ‘has been set. Joint operations between state and Pedsral . agencies Wnerein a tort occurs could be the foundation for a conspiracy claim under Section 1996. . -Ragarding the alleced vost-raid covar-up, Judge Swygert holds that the plaintiffs presented a prima facie case against the Federal deferdants. The alleged activities . in the post-raid coverup include the prosecutien of the sur-~ vivors, the manipulation of the news media, the internal police _avestigation, ane the Federal Grand J investiga- tion of the incident. What SAs sohnson, [—_[utechelt, and O'Neal have to do with any of these activities is beyond comprehension. Judge Swygert again "passes on the ultimate validity of plaintiffs’ clains.” ; Alleging violation of Sections 1986 and 1985{(2) of witle 42, U.S. Code (Obstruction of Justice), duege Swygeart finds a concerted effort to suppress the facts on the part Of the Feds ral Gefendants. He states that the Pederal da- a failed ; nz i ht by the Pederal defendants obstructed the discovery in the praesent civil suit. Judge Swygert Giscusses the doctrines of absolute and gqgualifiad immunity, holding the former not applicable to the Federal defendants. Concerning ths latter, Judge. Swygert states that the allecations of the plaintiffs in this case clearly complain of official misconduct which is voutsice the ambit of the doctrine of qualified immunity. b6 b7C b3 be | b7C freien SAE Rem dom Sd oe wen — ane ae te a
