between CAGGIANO and ACHTMANN but feels the request of
CAGGIANO was made because of his familiarity with the entire
transaction, as well as his abilities as an attorney.
WINFIELD and WOLFSON were present at this meeting
because WINFIELD was the aircraft broker and WOLFSON works
with bin.
SMITH said that the purpose of the meeting on the
24th was not clear to him at its commencement because he had
only been called epon by his law associate, CHARLES DAVIS, &
few minutes prior to the commencement of the meeting. Due
to some changes in the sub-lease agreement, the transaction
which originally had been contemplated to be closed in May
bad been delayed one month.
ACHTMANN bad given CAGGIANO a standard form lease
consisting of one page, front and back, with approximately
30 short paragraphs and provisions covering the lease agree~
ment for any particular chattel, which in this case was the
airplane. CAGGIANO was to complete this lease agreement on
June 25, 1976, and return the executed contract to ACHTMANN.
The delay in the execution of the contract was due to Mr.
DAVIS' poor health and it was to be resumed the following dy.
It was on this following day, June 35, 1976, that
~ QMITH learned BASZNER, on behalf of World Aircraft Exchange,
would handle the supervising of the upgrading of the sircraft
in order for it to qualify for the FAR 1231 Maintenance.
Riders were Grafted by Messrs. GUITH, DAVIS, anc - -
CAGGIANO, fecleding life imsuraace, ball iasurasce, and =.
iiabilities.
There was also s provision that the purchase Boney
would be released first to American Mational Bank to pay off
the outstanding indebtedness, then certain funds would go to
Air Cargo Express for upgrading the plane, and the balance of
the fends were to be released to World Aircraft Exchange for ~
@upervising, ¢irecting and reporting om the upgrading of the
aircraft as statements were issued for services rendered.
