Milnes Gentlemen: This letter will be your authority to enter upon Burlington Northern land in Sections 20, 21 amd 29, Township 6 North, Range 2 East, Cowlitz County, Washington, for the period from March 29, 1972, to May 1, 1972, for the purpose of establishing temporary helispots and control centers for conducting search operations in the area. You will cut only such timber as is necessary to clear a suitable work- ing area, The Government shall, at its sole expense, repair and/or restore any roads or other facilities on said described lands which are in any manner damaged or disturbed by its exercise of the rights granted by this letter. Burlington Northern shall not be Liable for damages to property or injuries to persons arising from the operations of the Government hereunder, andthe Government shall indemnify and save harmless Burling- ton Northern from all loss, costs and expense resulting from any such damage to property or injuries to persons, including damages to property of Burlington Northern, insofar as the Government may legally do so, and subject to the availability of appropriated funds, but excluding damage to property and injuries to persons caused by negligence in the operations of Burlington Northern, its successors and assigns, or its contractors, lessees, licensees or permittees.
