On June 3, 1952, Defense Counsel McTERNAN moved for a mistrial on the basis of a public address by United States Attorney MYLZS J. LANE on dune 1, 1952, in which he mentioned Communist espionage as disclosed in the case of the United States versus JULIUS “OSZPRBEnNG, Et Al. The motion was denied on June lh, 1952, On July 30, 1952, Defense Counsel McTERNAN moved for a mistrial because of the publication by Senator MeCARRAN of a pamphlet prepared by the Federal Bureau of Investigation captioned, "Documentary Proof that the Communist Party, USA, Teaches and Advocates the Overthrow and Destruction of the pabged States Government br Force ard Violence," dated March, 1952. Judge DIMOCHK questioned the jurors and was informed by them that none of them had read the above pamphlet. On August 1, 1952, the motion was denied. On August 1, 1952, Juror CHANLES CECIL CHATTERTCN was excu for iliness, and Alternate Juror NOBLE L. JONES replaced CHATTERTON as Juror Number 10. On Aucust 2€, 1952, a motion was made for the severance of Defendant MINDEL on grounds of illness, but decision was reserved. The motion was later renewed and denied. On September 16, 1952, Judge DIMOCK announced the finding that a prima facie case of conspiracy existed after Vi, GE . May, 1945, and he stated that the connection of the defendants va generally to the conspiracy had been established. <4 Judge DIMOCK stated that testimony as to incidents aad prior to May, 1945, would be received only against a particular os defendant as to the intent of that defendant.
