Senator Bayh called today to explain his proposed
method of handling intelligence information and access to same
during this investigation. It was his thought that staff
_ members Bill Miller, Mike Epstein and David Shaw would assist
the special counsel in this matter, Judge Tone, Bob Kelly and Michael
“Davidson, and that the latter three would prepare a report which
- gould go to the investigating committee and the investigators
which would not disclose sources and methods. He stated his
awareness that Mr. McDermott was a former Agent but preferred
to proceed as tightly as possible on this information. He
further stated that he was contecting Admiral Turner to advise
him of this policy.
' Apparently Mr. Felly already has top secret clearance
and an application for clearance of Mr. Davidson was made on
August 1st. We do not know whether any processing for Judge
Tone has taken place. We ought to be certain that we are on
top of any such application and move them forward swiftly.
If there is any question about who will need clearances,
. perhaps Mr. Nolan ought to contact Bill Miller.
