MEMORANDUM TO FILE
RE: ATLANTA DEATHS AND MISSING PERSONS
I met yesterday afternoon with Attorney General
Civiletti, Assistant Attorney General Drew Days, Assistant
Attorney General Philip Heymann and Mr. Monroe. We reviewed
the Bureau's assistance provided the Atlanta investigations
to date. All agreed that support similar to that provided
in Buffalo had been promptly made available in Atlanta.
Urgent requests fa assistance, from Commissioner Brown
and Mayor Jackson prompted the Attorney General to review
our jurisdiction to determine whether we were warranted
in taking further investigative action. The recent death
ef the 15-year-old black boy provides another incentive.
Various jurisdictional theories including civil
rights theories were discussed with the consensus in the
Department that ground for investigating, on a preliminary
basis, under the kidnap statute was the most defensible
theory. The Attorney General asked for a draft, to be
prepared by Mr. Days, and approved by me, whch would in
letter form to Mayor Jackson advise that he was now
authorizing and requesting additional assistance by the
FBI in the Atlanta area which would supplement, but not
duplicate the work of the Atlanta Police Department.
This morning Mr. Mullen showed me a telegram to
me from Mayor Jackson dated November 5, 1980, received
at 23:39 Z. While the telegram contains some pejorative
references to our withholding jurisdiction, it calls for
as much assistance as we are able to provide and invites
me to contact the Mayor personally. A newspaper article
appearing in the Atlanta Constitution indicates that Mayor

was somehow obstructing the SAC in providing assistance and
