Security Legislation in Couthern Rhodesia
The Untawful Oraanications Act came into effece in 1959. It provides for the
banning of ovranivations which,
"Cl) ave likely to endanger public safety, to disturb or interfere with
. public order, or te prejudice the tranquillity or security of the
Cotonyv; or
"(ii) are dangerous or prejudicial to peace, good order or constitutional
eovornment; or
"id) ore lihely te raise disaffeetion amonoe the inhabitants of the Colony
or to promote feelings of il] will or hactility between or within dif-
ferent races of the population in the Colony; ..."
There are penalties of up to five vears in prison for vielations of the law by
meabership in an unlawful organization, contributing to or soliciting for such an >
organization, ete.
Under chis Act botu the African National Consress af Southern Rhodesia and the
Vational Democratic Parcy, as well as a number of organivations based outside of the

Territory, vere declared unlawiul, i.e. "banned," a popular term not used in the Act,
The new amendwent to this Act provides that an organiration may be declared un-
lawful if ic
"dn) is the parent erganizaticn of an unlawful organization; or
{b) is derived from the same parent orgenization as an unlawful organization;
or
{c} is the successor of an unlawful orpanization; or
(a) is composed substantially though not necessarily predominantly of, or
directed or controlled, divectly or dndirectly, by, persons who have been
or are Officebearers or officers of an unlawful orpanization; .. ."
The atendment is not retroactive. ZAPU cannot be declared unlawful because of
being a Successor to the NDP.
