An item appeared in the "Washington Star"
on 1/3/58, indicating that a decision by Federal
Judge Edsund Palmieri of New York altered the
obscenity rule. oo.
The news item relates that the Government
bas broadened its legal standard for judging obscenity
of imported books, photos, and other materials. The
ruling laid down by the Judge is the rule that an
object is not legally obscene 42 the person importing
it had a genuine scientific purpose. The article
also indicated that the Solicitor General said the
Government would not appeal from this ruling and, in
effect, is tantamount to breadening of the Governnent's
original conception of ebscenity which had not considered
the status and purposes ef recipients of pornography.
The case before Judge Palmieri involved
aduittedly pornographic books, pictures, and other
objects imported from China by the above institate
and held in New York by the U. 8. Customs.

copy to the Bureau and Indianapolis for information
