FOUNDED BY ALFRED C, KINSEY
REQUEST FOR INFORMATION
As the legal representative of Dr. Pomeroy jmade the
| following specific requests. She asked that
Q) Dr. Pomeroy be granted the right to examine "erotica"
in the possession of this Bureau.
(2) Dr. Pomeroy be given or loaned “erotica” under restrictions
to be specified. . :
(3) If the "erotica" cannot be given or loaned, that Dr. Pomeroy
be given copies of the "erotica."
; - | _ requested that she be given a decision on the first request as soon
.S possible as Dr, Pomeroy would be in Washington, D, C., within a few days.
It was pointed out to |that the official files, documents, and
records of this Bureau are under the regulation of the Attorney General, and that
her request would be passed along to the Department of Justice.

be considered in this matter. Incl uded were the listing of eight 'scientifict™
questions which could be considered in justifying this research request. In
--addition she supplied Photostats of the opinion of U.S, District Judge for the sj
Southern District of New York Edmund L. Palmieri in the case “United States vs, .
31 Photographs" which stated on October 31, 1957, that "erotic'' materials |
imported into the United States for the purpose of scientific study could be |
legally delivered to the captioned Institute. She also supplied Photostats of
material collateral to this proceeding, including an affidavit of James V. Bennett,
Director of the Bureau of Prisons in which he states that science has a legitimate
interest in the study of "erotic't material and that the above Institute has made
substantial contributions to our knowledge in this field. The affidavit of Paul H.
Gebhard of this Institute revealed that considerable data had been collected from
authorities at penal institutions of five states, police as well as other law enforce-
ment authorities, and the courts in Baltimore, Maryland. Copies of material
enclosed to the Department have been prepared for Bureau files. Original material
for the Department is being held in Room 7 625 pending approval of enclosed letter,
