This brief contained a statement in tue appenaix expressing dsarm
conviction of those lawyers and criticizing the courts of the U. S.
for action taken in regard to that matter. According to the Informant,
this statement was siened by five individuals one of vhom was Professer
EINGTFIN. :

mimeograph pamphlet entitled, "The Case of the Eleven Cemmunist Leaders,"
prepared by the Civil Kights Congress, 23 West 26th St., New York ily
dated 5/51,
This pamphlet discussed the indictment and conviction of the
eleven Communist leaders under the Smith Act and urged the recipients
of the pamphlet to send letters to then President HARPY €, TRUMAN and
Attorney General HOVAPD MC GRATH demanding that the conviction of the
eleven Communist leadere be reviewed ard the Smith Act be declared
unconstitutional. Pages three and four of this pamphlet indicated
Frofessor EINSTSIE was among those protesting the contempt citatisn
of the defense attornevs of the eleven convicted CP leaders.

The "Newark Star Ledger," daily nevspeper of Newark, Neves
dated 6/12/53 contains” an article captioned, "EINSTEIN FAPS LOYALIY
FROBLS." According to this article in a letter dated 5/16/53 and made
public last nicht, ETYSTEL! accused "reactionary roliticians® -f
"proccveding va suppress the freedom of teaching avd te deprive of tieir
positions all those who do net prove svimissive. . . «7 This letter
had been addressed to ILLIAN: FRAUEMGLASS, a New York Fublic School
teacher, vho refused to testify before the Senate Internal Security
Sub-Committees. This article etated that EINST™IN had ureced witnesecs
