PURPOSE OF MEMORANDUM:
Pursuant to an inquiry from United States Attorney (USA) Macon
‘Weaver, Birmingham, this recommends that SAC Raymond L. Faisst
voluntarily appear at a session of the Federal grand jury in February, 1964,
in Birmingham to give a brief statement concerning the Bureau's participation
in the investigation of the bombing of the Sixteenth Street Baptist Church,
This conelusion is based on the following facts.
BACKGROUND:
USA Weaver in Birmingham has advised that the Federal Grand Jury
Foreman Clarence Pinson has requested that some information concerning the
investigation into the church bombing be presented to the grand jury which
convenes in Birmingham on 2/10/64. /
U. S. District Judge Clarence W. Allgood has taken the same
position according to USA Weaver and the USA has indicated that he would issue
a subpoena for the Special Agent in Charge (SAC).
USA Weaver was informed by SAC Faisst that if at all possible a
subpoena. should not be issued and if it was agreeable with Bureau headquarters
and with the Department we would prefer to appear on a voluntary basis without
any element of compulsion being present. USA Weaver has advised he would
not issue any subpoena until he heard from Faisst, i:
