Memorandum to Mr. Malley
Re: UNKNOWN SUBJECTS;
BOMBING OF SIXTEENTH STREET BAPTIST CHURCH
BIRMINGHAM, ALABAMA, SEPTEMBER 15, 1963
that I thought all that should be given was a brief statement that the FBI had
initiated an extensive special investigation at the very outset of this case
and that we were continuing to exert all-out effort to bring this thing toa
logical conclusion; that we had cooperated with the local authorities throughout
the investigation and were continuing to cooperate; that we had conducted
extensive technical examinations of various types of material which may have
a bearing upon the ultimate solution of the case through the facilities of our
technical services at the Bureau, the Laboratory, Identification Division in
particular, It was indicated that I thought SAC Faisst should appear and state f
to the members of the Grand Jury our position and assure them that we were
continuing our investigation looking to a solution of this matter and that we were
fy continuing to cooperate with the local authorities,

Nae I advised Faisst he would be given advice as to the Bureau's position
and that he would have this advice by February 7.
He indicated he was preparing a summary of the information which
they developed which he thought might be given to the Grand Jury. This
would be given to U. S, Attorney Weaver also and it would name names and
give the identities of principal suspects andthe nature of the investigation being
conducted. I advised him this was most undesirable, I thought, and that I did
not think we would approve furnishing any specific information at this time-
inasmuch as we had no Federal violation, It was indicated when we were ready
to present this case on the basis that there was a Federal violation in existence
we would then be in a position to give the United States Attorney a report. Until
that time there did not appear to be any obligation on the part of the Bureau
merely to give what could be considered an inadequate presentation to the
United States Attorney, I did not think this desirable,
The above information is for record purposes in connection with the
: teletype which Mr. Faisst furnished to the Bureau on February 5, It is my
j impression that Macon Weaver might be pushing for some comment in view of
; the fact that Judge Allgood had called this Grand Jury just about the time of the
4 bombing and, of course, everyone in the area was commenting on their personal
