File No. 100—428091 July 18, 1961 Res Remarks of Punctionaries of the Communist Party of the Soviet Union Regarding Henry Winston A source, who has furnished reliable information in the past, furnished the following information in July, 1961, concerning remarks made by functionaries of the Communist Party of the Soviet Union (CPSU) concerning Henry Winston: It is noted Henry Winston testified on September 20 and 23, 1949, before United States District Court, Southern District of New York, that he was National Organization Secretary, Communist Party, United States of America (CP,USA), since July, 1946. On October 21, 1949, he was sentenced to five years and fined $10,000.00 for violation of the Smith Act of 1940. On July 2, 1951, Winston became a fugitive upon issuance of a bench warrant by the United States District Court, Southern District of New York. On March 5, 1956, Winston surrendered to Federal authorities, Southern District of New York. On March 26, 1956, Winston was sentenced to three years for contempt of court to be served subsequent to the sentence imposed on the Smith Act conviction. On — June 30, 1961, Winston received a commutation of sentence by President John F. Kennedy and was released from custody.
